Mapping Regulatory and Institutional Pathways for Community Engagement in BESS Infrastructure Decisions

Structural Issue Identified

Following initial analysis of the proposed battery energy storage system (BESS) development near Cockenzie, it became clear that local residents were struggling to understand how concerns could be formally raised within the planning and regulatory system.

Multiple public bodies were involved in different aspects of oversight, including environmental protection, energy consenting, fire safety, and local planning. However, the responsibilities of these institutions and the correct pathways for submitting concerns were not clearly understood within the community.

What problem this work relates to

Large-scale energy infrastructure projects often involve complex regulatory systems distributed across multiple institutions. While these systems are designed to ensure environmental protection, safety, and accountability, they can be difficult for communities to navigate without prior experience of planning and regulatory processes.

When institutional responsibilities are unclear, community participation can become fragmented and concerns may fail to reach the appropriate authorities responsible for oversight.

Structural Adjustment & Implementation

To better understand the governance structure surrounding battery energy storage system developments in Scotland, I carried out a structured review of the relevant regulatory bodies and their roles in overseeing energy infrastructure projects.

This work included engaging with organisations such as the Scottish Environment Protection Agency (SEPA), the Energy Consents Unit, Scottish Fire and Rescue Service, local council authorities, environmental legal specialists, and relevant environmental organisations.

Freedom of Information requests were submitted where appropriate to clarify aspects of regulatory responsibility and oversight processes. The objective was to map how different institutions interact within the regulatory system and identify the formal pathways available for public participation and accountability.

Observable Effect

The research clarified the institutional landscape governing battery energy storage system developments and identified the specific regulatory channels through which concerns could be formally raised. This analysis formed the foundation for the next phase of work focused on translating these governance pathways into accessible guidance for community members.

Relevant Institutions and Policy Frameworks

The Energy Consents Unit (ECU) is the division of the Scottish Government responsible for processing applications for energy infrastructure projects exceeding 50MW, while any BESS project would also need to navigate the local planning authority for site-specific permissions and the Scottish Environment Protection Agency (SEPA) for environmental and pollution control regulations.
